Article 158. Shipping agent

Is a service in which a shipping agent, on behalf of the ship owner or ship operator, performs services related to ships operating at ports, including carrying out procedures for ships entering and leaving ports; signing transportation contracts, marine insurance contracts, cargo handling contracts, ship charter contracts, crew hiring contracts; issuing bills of lading or equivalent shipping documents; supplying materials, fuel, and food to ships; submitting maritime protests; communicating with ship owners or ship operators; services related to crew members; collecting and disbursing amounts related to ship operations; resolving disputes regarding transportation contracts or maritime accidents and other services related to ships.

Article 159. Shipping agent

1. A shipping agent is a person appointed by the principal to act as a representative to carry out shipping agency services as authorized by the principal at the seaport.

2. A shipping agent may perform shipping agency services for a charterer, a shipowner or other persons having a contractual relationship with the shipowner or ship operator, if agreed by the shipowner or ship operator.

Article 160. Shipping agency contract

A shipping agency contract is a written contract between the principal and the shipping agent, under which the principal authorizes the shipping agent to perform shipping agency services for each voyage or within a specific period of time.

Article 161. Responsibilities of shipping agent

1. The shipping agent is responsible for carrying out necessary activities to take care of and protect the legitimate rights and interests of the principal; must comply with the requests and instructions of the principal; promptly notify the principal of events related to the entrusted work; accurately calculate the revenues and expenditures related to the entrusted work.

2. The shipping agent is responsible for compensating the principal for damages caused by his own fault.

Article 162. Responsibilities of the trustee

1. The principal is responsible for instructing the shipping agent to perform the entrusted service when necessary and must advance the amount of money expected for the entrusted service upon the request of the shipping agent.

2. In case the shipping agent acts beyond the scope of the mandate, the principal shall still be responsible for that action, if immediately after receiving this information, the principal has not notified the relevant persons that he does not recognize this action of the shipping agent.

Article 163. Shipping agency service price

Shipping agency service prices are agreed upon by the parties, unless otherwise provided by law.
